Buying from the Website

  1. You acknowledge and warrant to Dyson that:
    • a) you are an Australian resident aged 18 years or over;
    • b) you will be liable for all costs, fees, charges and other amounts which may become payable to Dyson as a result of your use of this website;
    • c) you are not breaching any requirement of any applicable law relating to the privacy of personal information by providing the information to Dyson; and
    • d) all information (including credit card details) you provide to Dyson is true and complete.
  2. Your telephone order or on-line purchase order (as applicable) is an offer to buy from Dyson. All Australian orders should include a daytime delivery address and contact details. Dyson reserves the right not to accept an order at its sole discretion.
  3. By providing your details, you consent to receiving related communications from us, including confirmation that the order has been received by Dyson. Confirmation of the order does not constitute acceptance of your order. Dyson reserves the right at any time after receipt of your order to accept or decline your order for any reason (including stock run out), regardless of whether your order has been confirmed or your credit card has been charged or cheque or money order has been cleared. If your order is declined or cancelled by Dyson after the payment for the purchase, Dyson will promptly refund your payment.
  4. Payment for the goods which you order must be made either by credit or debit card, cheque or money order.
    • a) Payment for the goods with a credit or debit cards must be made by one of the following credit or debit cards: Mastercard or Visa. Your credit card will be charged at the time of Dyson receiving your order and prior to the time that the goods are dispatched and received by you. Dyson will provide you with an invoice number as confirmation of the order. If your payment is rejected by the card issuer your order will not be dispatched. Payment is made at your own risk.
    • b) Payment for the goods with a cheque or money order. Your cheque or money order will be cleared before the goods are dispatched and received by you. If your payment is rejected by the bank or post office, your order will not be dispatched. Payment is made at your own risk.
  5. The price of the goods (including for parts and accessories) (inclusive of GST), the applicable delivery costs and availability of the goods displayed on this website are subject to change without notice. The title to goods will only pass following payment in full.
  6. Delivery dates of the goods are intended to be an estimate only.
  7. Orders will only be accepted from and dispatched to street addresses in Australia.
  8. Orders will be delivered by post and we aim to have the goods delivered to you within 5-7 days of the acceptance of your order, subject to availability of stock. Delivery of the products may be totally or partially suspended by Dyson during any period in which Dyson may be prevented or hindered from delivery by its normal means of delivery or supply through any circumstances outside its reasonable control, including but not limited to strikes, lockouts, unavailability of stock, accidents or breakdowns of plant or machinery. Dyson will not be liable for any damages not reasonably foreseeable arising from its failure to deliver any or all of the products.
  9. Any failed delivery attempt due to incorrect details provided by you must be paid for by you. Subsequent delivery attempts may incur additional delivery charges.
  10. To the fullest extent permitted by applicable law, Dyson (including its employees, officers, agents and contractors) makes no representations about the materials contained on this website or any websites linked to this website.
  11. To the fullest extent permitted by applicable law, Dyson (including its employees, officers, agents and contractors):
    • a) is not liable to you or anyone else for any loss or damage, however caused (including negligence), which may suffered be directly or indirectly, in connection with use of this website including but not limited to interference with or damage to your computer systems; and
    • b) excludes liability (whether that liability arises under contract, tort (including negligence) or statute) for any special, indirect or consequential loss or damage (including without limitation loss of revenue and loss of, or damage to, data) suffered or incurred in connection with this website.
  12. The Australian Consumer Law provides for statutory guarantees that cannot be excluded by law. The limitations outlined in clause 11, and anywhere else in those document, will not operate to the extent they are inconsistent with those statutory guarantees.

    Dyson may vary these terms and conditions at any time. Any variations become effective on posting. By making a purchase through this site after the terms and conditions have been varied, you agree to be bound by the variation.

    You must return the goods in their original packaging to us at your expense to: Dyson Accessories, 8-10 Mangrove Lane, Taren Point NSW 2229. Note that if you fail to take reasonable care of the goods we might not be able to accept their return. Otherwise, we will refund the full purchase price to you. Goods returned by you because of a defect will be refunded in full, including a refund for costs incurred by you in returning the goods to us.

Dyson Appliances Ltd (Dyson) may collect and use your personal information to provide you updates on latest products and services, to analyze and research on customer’s choice on products, to provide products and services you have requested and for other purposes relating or incidental to warranty (e.g. warranty registration, product recalls) (“the Purposes”). To do so, Dyson may disclose your personal information to its related bodies, business partners or third parties. Some of the recipients are located overseas, including United States of America, Amsterdam and United Kingdom.

If Dyson does not collect your personal information, then it may not be able to fulfil the Purposes.

Dyson V6 Absolute Airbnb Host Gift

  1. The promoter of this offer is Dyson Appliances (Aust.) Pty Limited (ABN 50 073 072 509) of 8-10 Mangrove Lane, Taren Point, NSW 2229 (“Promoter”).
  2. The Promoter has teamed up with Airbnb Australia Pty Limited (ACN 153 841 493), Suite 401, 441 Elizabeth Street, Surry Hills NSW 2010 (“Airbnb”) to invite you to participate in this offer and receive a Gift (as defined in clause 5) Only those individuals who are directly invited via email by Airbnb are eligible to take part in this offer and receive a Gift.
  3. Instructions on how to claim and the Gift form part of these Terms and Conditions. Accepting the Gift is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
  4. To claim the Gift, eligible Airbnb Hosts must click on the link within the email sent by Airbnb confirming your eligibility for the Gift, follow the prompts to the claim form, input the requested details including your title, full name, mobile number, email address, your Airbnb property address and Airbnb listing ID, check the box agreeing to the Terms and Conditions and select whether you would like to receive further marketing communications from Dyson and submit the fully completed online claim form. All online claim forms must be received by 17:30pm AEDST on 15th December 2015 in order to be valid. Any individual who fails to submit a claim or submits a claim after this date will not be eligible to receive a Gift.
  5. Subject to clause 6, the gift is a Dyson V6 Absolute vacuum valued at $899.00 RRP (“Gift”) and includes installation by an authorised Dyson installer. The Gift must be installed by an authorised Dyson installer and must be installed in your Airbnb listed property. The Gift cannot be installed in a rented property, the property must be owned by the Airbnb Host. Installation will be organised by the Promoter on a date and time that you and the Promoter both agree on. In the event that a date and time cannot be agreed upon, the Promoter reserves the right to determine the date and time for installation.
  6. In the event that you already have a Dyson Cordless vacuum installed in your Airbnb listed property, the Promoter may in its absolute discretion, organise for your Dyson Cordless vacuum currently installed in the Airbnb property to be upgraded to a Dyson V6 Absolute vacuum. In the event you already have a Dyson V6 Absolute Machine installed in your Airbnb listed property, the Promoter may in its absolute discretion and on a case-by-case basis organise for an alternate Dyson product (selected by the Promoter) to be awarded to you.
  7. Only one (1) Gift is permitted per person.
  8. The Promoter reserves the right, at any time, to verify your validity and your claim (including your identity, age place of residence and Airbnb listed property) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the offer. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  9. Incomplete or indecipherable claims will be deemed invalid.
  10. If there is a dispute as to your identity, the Promoter reserves the right, in its sole discretion, to determine your identity.
  11. The Promoter’s decision is final and no correspondence will be entered into.
  12. If for any reason you do not take the Gift at the time stipulated by the Promoter, then the Gift will be forfeited.
  13. If the Gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the Gift with a Gift to the equal value and/or specification.
  14. Gift are not transferable or exchangeable and cannot be taken as cash.
  15. You consent to the Promoter using your name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this offer (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  16. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Airbnb (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the offer.
  18. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Airbnb (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s or Airbnb’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or Airbnb) due to any reason beyond the reasonable control of the Promoter or Airbnb; (d) any variation in Gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by you; or (f) use of a Gift.
  19. As a condition of accepting a Gift, you must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
  20. The Promoter collects personal information ("PI") in order to conduct the offer and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.dyson.com.au/support/privacy-policy.aspx. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will only disclose entrant’s personal information outside of Australia if such disclosure is in accordance with the Privacy Policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, if you “opt in” to receive further marketing communications from the Promoter at the time of submitting your claim (in accordance with Clause 4), the Promoter may, for an indefinite period, unless otherwise advised, use your PI for promotional, marketing, publicity, research and profiling purposes, including sending you electronic messages and/or telephoning you.

Dyson Airbnb Guest Offer Promotion

  1. The instructions on how to claim and the Promotional Offer (defined below) form part of these Terms and Conditions. Participation in the ‘Dyson Airbnb Guest Offer’ promotion ("Promotion") is deemed acceptance of these Terms and Conditions. This Promotional Offer is not valid in conjunction with any other offer.

  2. Claims are only open to Australian residents aged 18 years and over who have stayed in an eligible Airbnb property during the corresponding Promotional Period (defined below). Claims are not open to companies, businesses and/or organisations of any description.

  3. Employees (and their immediate families) of the Promoter, participating Airbnb properties and agencies associated with this Promotion are ineligible to enter. “Immediate families” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

  4. The Promoter is Dyson Appliances (Aust.) Pty Limited (ABN 50 073 072 509) of 8-10 Mangrove Lane, Taren Point, NSW 2229 (“Promoter”).

  5. The promotion will be conducted in participating Airbnb properties within Melbourne, Sydney, Brisbane and Perth (“Participating States”) during the Promotional Periods as defined and outlined in the table below:

  6. Participating State Promotion Dates and Times (each a “Promotional Period”)
    Melbourne The Promotion in this Participating State will commence at 8:00am AEDST on Monday, 19 October 2015 with final claims ending at 23.59 AEDST on Sunday, 31 January 2016.
    Sydney The Promotion in this Participating State will commence at 8:00am AEDST on Monday, 16 November 2015 with final claims ending at 23.59 AEDST on Monday, 29 February 2016.
    Brisbane The Promotion in this Participating State will commence at 8:00am AEDST on Monday, 30 November 2015 with final claims ending at 23.59 AEDST on Monday, 29 February 2016.
    Perth The Promotion in this Participating State will commence at 8:00am AEDST on Monday, 18 January 2016 with final claims ending at 23.59 AEDST on Thursday, 31 March 2016.

    For the purposes of this Promotion, the participating Airbnb properties will be the Airbnb properties in each Participating State that have a Dyson V6 Absolute vacuum installed in the property, that has a promotional sticker advertising this Promotion on the cradle of the Dyson V6 Absolute vacuum, during the relevant Promotional Period (“Participating Airbnb Property”). For the sake of clarity, if an Airbnb property, in any of the Participating States: (a) does not have a Dyson V6 Absolute vacuum installed in the property; and/or (b) has a Dyson V6 Absolute vacuum installed in the property but the Dyson V6 Absolute vacuum does not contain a promotional sticker, then these Airbnb properties are not participating Airbnb properties and will not be eligible to receive the Promotional Offer.

  7. For the purposes of these Terms and Conditions:
    a. "Promotional Offer" means 35% OFF the recommended retail price (RRP) of the Eligible Product (defined below) as communicated on the Website (defined below) at the time the purchase is made;
    b. “Eligible Product” means the Dyson V6 Absolute cordless vacuum, valued at $899.00 RRP; and
    c. "Website" means http://www.dyson.com.au/shop

  8. To claim the Promotional Offer, individuals must complete the following steps during the relevant Promotional Period:
    a. stay in a Participating Airbnb Property during the relevant Promotional Period and enquire about the Promotion via their Airbnb Host;
    b. upon their enquiry, receive a card from their Airbnb Host which contains a unique discount code (which will need to be used to claim their Promotional Offer) and instructions on how to claim;
    c. Individuals must then visit the Website during the relevant Promotional Period, add the Eligible Product to their online basket; and
    d. enter the unique discount code at the checkout and fully complete and submit their online purchase so that it is received within the relevant Promotional Period to claim their Promotional Offer.

  9. The Promotional Offer is only valid for use on one (1) Eligible Product per person within the relevant Promotional Period. All valid claims must be made via the Website.

  10. The Promoter reserves the right, at any time, to verify the validity of claims and claimant’s (including a claimant’s identity, age and place of residence and reserves the right, in its sole discretion, to cancel the order of any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

  11. Incomplete claims will be deemed invalid.

  12. Claimants must retain their original unique code to be eligible to claim their Promotional Offer.

  13. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.

  14. If for any reason a claimant does not redeem their Promotional Offer during the relevant Promotional Period, then the Promotional offer will be forfeited.

  15. The Promotional Offer is not transferable or exchangeable and may not be taken as cash, unless specified otherwise by the Promoter in its absolute discretion.

  16. The Promoter’s decision is final and no correspondence will be entered into.

  17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

  18. Any cost associated with accessing the Website is the claimant’s responsibility and is dependent on the Internet service provider used.

  19. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Promotional Offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) claiming a Promotional Offer and/or use of the Eligible Product.

  21. The Promoter collects personal information ("PI") in order to conduct the Promotion and for the purposes of processing sales. Claiming is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.dyson.com.au/support/privacy-policy.aspx. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All claims become the property of the Promoter. The Promoter will only disclose claimant’s personal information outside of Australia if such disclosure is in accordance with the Privacy Policy.
